Data room with information on the bidding process has been opened to the public since September 12.
Public consultation on bidding documents is also available on the Bank’s website until October 11.
The Brazilian Development Bank (BNDES) is holding a public hearing on Tuesday, November 26, from 10:00 a.m. to 12:00 p.m., to gather suggestions and contributions concerning the information made available for public consultation on the concession to run the instant lottery Loteria Instantânea Exclusiva, or Lotex. The hearing will be at the Auditorium of Ernst & Young Auditores Independentes, Avenida Praia de Botafogo 370, 10th floor, in the Rio de Janeiro district of Botafogo.
The instant lottery business is based on a previously established and known prize structure that generates printed or virtual tickets. No external event is needed (such as a draw) for bettors to find out whether they have won.
Since September 12, the
BNDES website (in Portuguese) has featured a link to the data room with information on the bidding process for the Lotex concession, comprising Legal Framework Analysis, Business Plan and the Contract and Notice drafts (both in Portuguese and English).
Also available online since the 12th is a public consultation in which anyone can send suggestions and contributions by e-mail regarding the bidding process. The public consultation will receive contributions until 6:00 p.m. on October 11, 2017.
The public hearing on March 26 will be conducted by BNDES and the Brazilian Ministry of Finance and will feature a presentation of the Lotex privatization project, followed by answers to written questions submitted at the actual hearing, and concluding with oral statements by the audience in order of registration. The results of the public hearing will be published in a report, which will be available at the data room.
Process phases – The Lotex privatization process was determined by the Executive branch through Decree 9,155, dated September 11, 2017, signed by President Michel Temer.

The decree designates BNDES as “responsible for carrying out all actions necessary to implement the privatization,” which includes hiring the institution responsible for the auction; calling a public hearing; publishing a public consultation; designating a bid committee; drafting documents and checking their legality; publishing the bid notice; and other ensuing measures until the process is finalized.
The Lotex concession bidding process also includes analysis by the Brazilian Federal Court of Accounts (TCU), which is already in progress, roadshows for investors – scheduled for September 28-29 in London (Great Britain); October 2-3 in Las Vegas (USA); and October 6 in Rio de Janeiro – and publication of the concession notice. The auction is scheduled for 60 days following publication of the notice and is expected to be held by December.
